1. The Nature of Our Service

Welcome to Swapze™. If you do not agree to these terms, please do not use the platform. Swapze™ is a facilitation venue only. We provide the digital space for users to list and swap items.

No Ownership: Swapze™ at no point takes ownership or possession of items.

The Contract: The agreement to swap is a direct contract between the two users. Swapze™ is not a party to this transaction and disclaims all liability regarding item quality, safety, or legality.

2. Listing and Retractions

Accuracy: Listings must be honest, include clear photos, and disclose all known defects.

The "Swapze Handshake": Once an offer is accepted, it is considered a binding commitment. Repeated failure to complete accepted swaps ("no-shows") will result in account termination.

3. Prohibited Items

You must not list items restricted by UK law. We maintain a Zero-Tolerance Policy for, but is not limited to:

Weapons

Offensive Weapons Act 2019

Flick Knives, Knuckledusters, Firearms etc

Regulated Goods

Licensing Act 2003

Spirits & Wine, Vapes & E-Cigarettes etc

Controlled Drugs

Misuse of Drugs Act 1971

Cannabis, Prescription Drugs, Psychedelics etc

Adult Content

Online Safety Act 2023

Pornography, Sexualized Content, Sex "Toys" etc

Counterfeit/Stolen Goods

Trade Marks Act 1994 / Theft Act 1968

Fake Designer Bags, iCloud-Locked Phones, Unbranded Tech Chargers etc

4. Prohibited Conduct and Platform Safety

You agree not to:

Harm the Community: Engage in hate speech, harassment, or publish content promoting terrorism, discrimination, or self-harm.

Manipulate the System: Use bots, scrapers, or "spam" listing tactics (e.g., deleting and re-listing the same item repeatedly).

Violate Privacy: Collect or disclose other users' personal data without their consent.

Technical Sabotage: Introduce malware, reverse-engineer the site, or attempt to bypass our security measures.

5. Rights to Terminate

Swapze™ reserves the right to remove listings, suspend accounts, or ban users permanently without notice if these Terms are breached. Our decision on account status is final.

6. Limitation of Liability

To the fullest extent permitted by law, Swapze™ shall not be liable for:

Any loss or damage arising from a swap (e.g., if an item is broken or not as described).

Personal injury resulting from a swapped item.

Any disputes between users. We encourage users to use tracked shipping and meet in safe, public places for in-person swaps.

7. Tax & HMRC Compliance (P2P Reporting)

Under the Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023, we are required to monitor and potentially report high-volume activity.

Reporting: If you exceed 30 transactions or £1,700 in value per year, we are legally mandated to collect your National Insurance (NI) number and report your activity to HMRC.

Responsibility: You are solely responsible for any tax (Income or Capital Gains) arising from your trades.

8. Governing Law & Jurisdiction

These Terms of Use, and any dispute or claim arising out of them, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute, provided that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
